There may be instances where real property is bought without individual or strata title as it has not been issued at the time of the purchase, in which case the legal ownership of the real property does not pass to the purchaser and the purchaser is merely a beneficial owner (where the purchaser has the rights and interest in and to the real property).

When loan is obtained, real property is sometimes offered as security by a borrower, where:
a charge is registered over the real property in favour of the lender (where title has been issued); or
the rights and interests of the real property is assigned and power of attorney is granted to the lender (where title has not been issued).
to secure the lender’s interest, where in the event of default by the borrower (e.g. non-payment of loan), the lender may foreclose and auction the real property to recover the outstanding loan.
Therefore, upon the satisfaction of the loan, it is important to either:
obtain a discharge of charge over the real property and redeem the original title (where title has been issued); or
execute a reassignment of the right and interest of the real property back to the real property owner, revoke the power of attorney granted to the lender, and redeem all the original documents deposited with the financial institution (where title has not been issued).
