All employees including apprentices with apprenticeship of between 6 to 24 months are covered under Employment Act 1955.
However, not all employees are entitled to all the benefits prescribed under Employment Act 1955.
Employees whose basic salary exceeds RM4,000 a month will not be entitled to the following benefits:
additional wages for work on rest day
additional wages for overtime
allowance during shift work
additional wages for work on paid holiday (namely 11 of the gazetted public holidays and public holiday appointed under Section 8 of the Holidays Act 1951)
termination, lay-off and retirement benefits
Despite earning basic salary of more than RM4,000 a month, an employee is still entitled to all the benefits under Employment Act 1955 if he or she is –
engaged in manual labour (at least half the time he is required to work within the wage period) including artisan or apprentice;
engaged in the operation or maintenance of mechanically propelled vehicle operated for the transport of passenger or goods or for reward or for commercial purposes; or
supervises or oversees other employees engaged in manual labour under the same employer.
Irrespective of the monthly basic salary, an employee who is engaged in any capacity in any vessel registered in Malaysia and –
is not an officer certified under the Merchant Shipping Acts of the United Kingdom;
is not the holder of a local certificate as defined in Part VII of the Merchant Shipping Ordinance 1952; or
has not entered into agreement under Part III of the Merchant Shipping Ordinance, 1952
are entitled all the benefits under Employment Act 1955 except benefits in respect of rest day, hours of work, task work, shift work, holidays, annual leave, sick leave and paternity leave.
Further, irrespective of the monthly basic salary, a domestic employee (namely employee working in a private dwelling house) are entitled all the benefits under Employment Act 1955 except benefits in respect of –
notice of termination of contract
advances to employees
rest day, hours of work, task work, shift work, holidays, annual leave, sick leave and paternity leave
duty of employer to keep registers and display notice boards
pregnancy and maternity
termination, lay-off and retirement benefits

不是《1952年商船条例》第 VII 部所定义的本地证书持有人; 或
未根据《1952年商船条例》第 III 部达成协议
